1. Agreement and Eligibility
Cake: Birthday Reminders ("Cake") and cake.bysnapps.com (the "Website") are provided by BYSN Apps, operated by Alec Fradkin in Massachusetts, United States. These Terms govern use of Cake and the Website. If you cannot legally agree, use them only with permission from a parent or legal guardian.
These Terms are between you and BYSN Apps, not Apple. They supplement Apple's applicable App Store terms, including Apple's Standard Licensed Application End User License Agreement where it applies. Our Privacy Policy explains how information is handled.
2. License and Acceptable Use
Subject to these Terms and Apple's applicable usage rules, BYSN Apps grants you a limited, non-exclusive, non-transferable license to use Cake on Apple-branded products you own or control. Cake is licensed, not sold.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, interfere with, or use Cake unlawfully, except to the extent applicable law permits. The license may end if you materially breach these Terms, subject to applicable law.
3. Your Content and Device
You retain ownership of content you enter, import, or create. You are responsible for its accuracy and for having any permission or legal basis needed to store or share information about other people.
You control Cake's permissions, device settings, backups, and Nearby Share recipients. BYSN Apps cannot recover content it does not receive. Information written to Contacts or retained through Apple services may remain outside Cake until you remove it through the relevant Apple or device controls.
4. Reminders and Information
Reminder delivery depends on Apple systems, device settings, permissions, and conditions outside BYSN Apps' control. Reminders may be delayed or not delivered, so Cake should not be your sole means of remembering an event where a missed reminder could cause harm.
Facts, calculations, astrology, numerology, and similar material in Cake are for general information or entertainment. They may be approximate or outdated and are not medical, scientific, legal, or other professional advice.
5. Ownership
Cake and the Website, including their software, design, and BYSN Apps content, are owned by or licensed to BYSN Apps and protected by applicable intellectual-property laws. These Terms grant no rights beyond the limited licenses stated here.
6. Availability and Consumer Rights
Features, compatibility, and availability may change over time. BYSN Apps may modify, suspend, or discontinue Cake, the Website, or a feature, subject to applicable law.
BYSN Apps does not promise uninterrupted or error-free operation or delivery of reminders.
Nothing in these Terms excludes or limits any consumer right or remedy that cannot lawfully be excluded or limited.
7. Limitation of Liability
To the extent permitted by applicable law, BYSN Apps is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, Cake or the Website. This limitation does not apply to liability that cannot lawfully be excluded or limited.
8. Changes and General Terms
BYSN Apps may update these Terms prospectively. Material changes will be posted on this page with an updated last-updated date and any additional notice or consent required by applicable law.
Massachusetts law governs these Terms, without depriving you of mandatory protections under law that applies where you live. A dispute may be brought in a court with jurisdiction under applicable law.
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
